Buyer's and Seller's Secure Benefit Membership

Definitions:

  1. Transaction = the process of buying and selling
  2. Arbitrator = the middleman assigned by HexaDyne LLC to handle a dispute
  3. A Dispute = a filed disagreement on one purchase order
  4. Member = a member of HexaDyne's Secure Benefit Membership
  5. We/Our/Us = HexaDyne LLC, HexaDyne.com or any person representing HexaDyne LLC.

Secure Benefit Membership --

The Secure Benefit Membership is an optional service.  It is designed to help reduce monetary loss due to attempted fraud.

  • This service best suits those who are regular Buyers or Sellers but can be purchased by a one time Buyer or Seller.
  • This membership is a three month membership but can be terminated at any time by the member, when they fill out the Intent To Quit form on our site, for a full refund provided no transactions are left unfinished and there are no disputes in progress. (see under Buyers or Sellers)
  • This membership can be terminated by us anytime a member abuses our system with no refund.
  • Without becoming a member, a buyer or seller is left to their own resources when there is a dispute.  We will not be able to help you.
Benefits from the Secure Benefit Membership:
  1. An Arbitrator is available as the middleman in case of a dispute.
  2. Membership is for three months or 2 disputes, which ever comes first.
  3. If the buyer or seller has no disputes the membership fee is refunded within 5 working days after the three months has ended or from notification through our Intent To Quit form.
  4. After three months, if the buyer or seller has no disputes on record they may remain a member for another three months at no additional cost.
  5. If a member has 2 disputes before the three months are up a member may purchase an extension of membership for the rest of the three months, or 2 disputes which ever comes first, for the usual fee, refundable if there are no disputes.
  6. The member filing the dispute does not have to do all the paper work and contacting, the arbitrator will.  In essence, the member does not have to deal with the hassles.
HexaDyne LLC, HexaDyne.com or anyone affiliated with HexaDyne LLC will not be responsible for any disputes, the costs incurred by any disputes nor will we be liable for the outcome of any disputes of non-members.  For members our responsibility is limited to what is mentioned under USES and LIMITATIONS


Important Information --

Many people are concerned with online purchase fraud.  In an effort to try and eliminate monetary loss due to possible fraud, we have researched several avenues in which we could possibly accomplish the task on our site.

There are three:
  1. The first is that we can not help in eliminating monetary loss due to attempted fraudulent transactions without some form of control.  These would be:

    • Buyers or Sellers that do not want to sign up as a member.
      Without becoming a member we can not be your arbitrator in disputes.
    • Sellers do not choose to use our HD System for selling their items.
      Without the control of the funds of the transactions we can not justly arbitrate.

  2. Second, we choose to use PayPal as our online credit card and electronic check transactions carrier for the following:

    • We have control of the funds without having your credit card or bank information.
    • Their system allows us to keep track of each transaction's information such as item purchased, by whom, who the seller is and all contact information so everyone can do business smoothly.
    • Their system does credit card and electronic check validations.
    • They have coverage policy for a charge-back.

  3. Third, we have come up with an Arbitration System in which if buyers and sellers follow the steps of the Arbitration System, unnecessary, and possibly costly disputes, can be avoided thereby also avoiding loss due to fraud or attempted fraud on our site.

    NOTE: This Arbitration System is offered to Buyers and Sellers that are Secure Benefit Members at a reduced rate from our one time Arbitration Service Fee which is offered to any buyer or seller.


The Arbitration System --

  1. First a buyer or seller must sign up as a Secure Benefit Member to receive the Secure Benefits.  As a member:

    1. You will have the availability of an Arbitrator should there be a dispute over the item(s) purchased. (see Limitations)
    2. Any charges incurred upon us from a dispute is billed accordingly:

      1. First, to the losing party when both parties are members.

        OR

      2. To the party that is a member who files the dispute when the other is not a member.

      These charges will be subtracted from the member's membership fee if the billed charges are not paid by the invoice due date.

  2. Second, the buyer or seller must sign up for the Secure Benefit Membership before any transactions occur for that transaction to be included in the reduced Arbitration Service fee rate (see buyer exception).

  3. Third, if a buyer or seller has a dispute and is not a member they may purchase the non-refundable, one per dispute, Arbitration Service.


The Purposes, Uses and Steps of the Arbitration System.

Purposes:
  1. To prevent the buyer from attempting to gain a fraudulent refund.
  2. To prevent the seller from attempting to scam the buyer.
  3. To keep HexaDyne.com a trustworthy site for members to feel good about selling and buying items.
Uses:
  1. Phone calls made during any investigation.
  2. Postage and paper needed for any mailings during investigations.
  3. Time spent during performing arbitration steps.

Fees and what they are for:
  1. Secure Benefit Membership Fee is $40 for three months or 2 disputes.
  2. $20.00 per dispute for members.  $40.00 per dispute for non-members.
  3. To pay for any investigation costs we need to make on behalf of the buyer or seller.
  4. To pay for penalties incurred when buyer or seller does not abide by the contract they agreed to for transacting on this site.
Our Arbitration System Steps:

These are basic steps of the Arbitrator which will commence within 3 working days once we have received a dispute notification.
  1. Step 1.  Send email to the party the dispute is against with request for information needed.  A copy of the dispute will be included.
  2. Step 2.  Once a response is received appropriate actions will be taken and an email copy of these actions will be sent to both parties.
  3. Step 3.  If an email response is not received within 3 working days a second email will be sent with copies of the first email as well as a copy of the dispute.  If a response is received then Step 2 applies.
  4. Step 4.  If an email response is still not received within 3 working days, after the second email, then a written letter is sent via Certified and Return Receipt to the party the dispute is against with printed copies of the dispute and all emails sent.  A request for immediate response by email or by phone call will be asked as well as what actions may be taken.  If a response is received then Step 2 applies.
  5. Step 5.  If no response is received by the time we receive the Return Receipt (approximately 7-10 days within the US, after mailing) then a phone call is made. 
    1. A message will be left if the party does not answer (if there is an answering machine).  If the party is there to speak to then Step 2 applies.
  6. Step 6.  If there is no answering machine or the party does not return the call within 3 working days then a second call is made and Step 5a applies.
  7. Step 7.  If there is no reply from the party the dispute is against after all the attempts to contact them have been exhausted, then the award goes to the party that filed the dispute and a Certified and Return Receipt letter will be sent to the offending party of the final action taken.  At this point all monies associated with the transaction will be awarded, by default, to the party that filed the dispute.

NOTE: None of these steps will need to be taken if all buyers and sellers abide by the terms and conditions they agreed to on this site.  Remember, just because you are honest doesn't mean everyone else is, although we'd like to think good of others.  Since the Secure Benefit Membership is fully refundable when there are no disputes, it may save you the extra cost and hassles to purchase the membership just for a back-up, especially if you intend on doing a lot of business here.

LIMITATIONS:  There are limitations to what the Arbitration System can do.  The limits are specified in USES mentioned above and in the following details.

  • If the party filing the dispute wants to continue with the investigation beyond what the Steps mentioned in this terms and conditions policy, then it is up to the disputer to file a report with the legal system to continue with a lawful and legal pursuit.  There will be no further investigations on our part.
  • Should the disputer take further steps through the legal system and need our help, we will be limited to submitting all correspondence to the legal authorities (lawyer) that prove certain procedures have already been taken to try and obtain a lawful settlement outside the legal system.
  • No funds can be transferred while an investigation is taking place.
  • We offer assistance to only members of the Secure Benefit Membership or if the Arbitration Service was purchased.  No assistance is offered to a non-member or one who did not purchase the Arbitration Service.

NOTE:  We are not lawyers, paralegals nor any form of legal governmental agency and the Arbitration System is only used as a service to our members to help our members from possible monetary loss due to fraud attempts while doing business on this site.  Under no circumstances do we take any actions other than what is listed under USES and LIMITATIONS.
